11. Septic Tank Access & Liability Acknowledgment (Real Estate Inspections)
The following terms apply specifically to septic tank pumping and access services performed in connection with real estate septic inspections scheduled through Drainfield Solutions, LLC (“Company”).
By scheduling or authorizing septic inspection or pumping services, the property owner or authorized representative (“Customer”) acknowledges and agrees to the following:
a). Depth of Tank Lids
Drainfield Solutions, LLC will hand-dig to uncover septic tank lids up to two feet (2’) in depth.
If lids are located deeper than 2’, mechanical excavation equipment may be required. Additional charges may apply in such cases.
b). Tank Lid Access
Customer understands that tamp bars or similar tools may be used to unseal septic tank lids.
These tools are required due to natural sealing caused by gases and environmental conditions and are not used to cause intentional damage.
Drainfield Solutions, LLC is not responsible for chips, cracks, or other damage to tank lids that may occur as a result of the necessary process of accessing the tank.
c). Driveway & Surface Damage
Septic pumping trucks are large commercial hauling vehicles.
Drainfield Solutions, LLC is not responsible for damage to driveways, parking areas, sidewalks, curbs, landscaping, irrigation systems, or other surfaces that may result from vehicle weight, ground conditions, or maneuvering required to perform the service.
d). Private Utilities
Customer is responsible for clearly marking the location of any private utilities, including but not limited to irrigation lines, private electrical lines, cable/internet lines, propane lines, or private water lines.
Drainfield Solutions, LLC is not responsible for damage to unmarked, improperly marked, or undisclosed private utilities.
12. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any legal action related to these terms must be brought in the courts located in Virginia.
13. Changes to Terms
We reserve the right to modify these Terms & Conditions at any time. Any changes will be effective immediately upon posting to the website. It is your responsibility to review these terms periodically to stay informed of any updates.
